CG 20 38 04 13CGL

Additional Insured (Automatic, Ongoing & Completed Operations) — 04 13 Edition

Current automatic AI form covering ongoing AND completed ops, including upstream required parties.

What it actually does

CG 20 38 04 13 is the April 2013 edition of the automatic additional-insured endorsement that includes both ongoing and completed operations. It grants automatic AI status to any party the named insured has agreed in a written construction agreement to add, and — distinctively — to any other person or organization that upstream party in turn requires (for example, the owner above the GC).

The 04 13 edition includes the "not broader than required by the contract" language and the lower-of-limits cap. Because it bundles both timing windows and reaches upstream parties, it is frequently the form GCs require on tiered projects.

It still depends on a signed written construction agreement in force before the loss. There's no schedule to check — instead, verify the contract chain actually requires the AI status you're relying on.

Verification checklist

  • 01Confirm the lower-corner edition reads '04 13'.
  • 02Verify a signed written construction agreement requires AI status for you (and any upstream party you're relying on).
  • 03Check the limits cap against contract-required limits.
  • 04Confirm the agreement predates any loss.

Which edition do you have?

The 04 13 edition added the limits cap and contract-limiting language to the bundled automatic form. Its reach to "other parties" required by the written contract is what distinguishes it from CG 20 33/20 38 ongoing-only or scheduled forms.

Common mistakes

  • ·Assuming CG 20 38 covers every party broadly — it only covers those the written contract requires.
  • ·Relying on it without a signed agreement in force before the loss.

Frequently asked questions

What makes CG 20 38 04 13 the 'gold standard'?

It's automatic (contract-triggered), bundles ongoing and completed operations, and reaches upstream parties the contract requires — all in one form.

Does CG 20 38 04 13 need a schedule?

No. Like other automatic forms it's triggered by the written construction agreement; there's no party schedule to verify.

Is a written contract still required?

Yes — automatic status only applies when a signed written construction agreement requiring AI status is in force before the loss.
