CG 20 33 04 13CGL

Additional Insured (Automatic, Ongoing Operations) — 04 13 Edition

Current automatic ongoing-ops AI form — contract-triggered, with the 04 13 limits cap.

What it actually does

CG 20 33 04 13 is the April 2013 edition of the automatic ongoing-operations additional-insured endorsement. It confers additional-insured status on any party the named insured has agreed, in a written construction agreement, to add — no schedule required — for liability "caused, in whole or in part, by" the named insured's ongoing operations.

The 04 13 edition adds the "not broader than required by the contract" language and caps the additional insured's recovery at the lesser of the contract-required limits or the policy limits. It also does not apply if a separate, more specific additional-insured endorsement (such as a scheduled CG 20 10) is attached for the same party.

Like all automatic forms it requires a signed written agreement in force before the loss, and it covers ongoing operations only — pair with CG 20 38 or CG 20 37 for completed operations.

Verification checklist

  • 01Confirm the lower-corner edition reads '04 13'.
  • 02Verify a signed written construction agreement requires AI status.
  • 03Check the limits cap against the contract-required limits.
  • 04Pair with CG 20 38 or CG 20 37 04 13 for completed operations.

Which edition do you have?

The 04 13 edition added the limits cap and contract-limiting language to the automatic ongoing-ops form. Its automatic trigger still depends on a signed written construction agreement existing before the loss.

Common mistakes

  • ·Relying on automatic status without a signed contract in force before the loss.
  • ·Accepting ongoing-ops automatic AI when completed operations are required.
