Waiver Of Subrogation (CGL) — 12 19 Edition
The current CGL waiver edition — adds optional blanket wording for contract-required waivers.
What it actually does
CG 24 04 12 19 is the December 2019 edition of the CGL waiver of subrogation. Its key advance over the 05 09 edition is optional *blanket* wording: in addition to naming parties in a schedule, it can waive subrogation against any person or organization for whom the named insured has agreed in a written contract — executed before the loss — to provide a waiver.
This makes it function like a blanket waiver, so a GC protected by a written subcontract is covered without being individually scheduled. It's the edition GCs increasingly require because it eliminates the "your name wasn't on the schedule" failure mode.
When verifying it, confirm whether the blanket box/wording is active (some issuances still use only the schedule), and that a qualifying written contract exists. As always, the CGL waiver is separate from the workers' comp and umbrella waivers.
Verification checklist
- 01Confirm whether the blanket wording is active or only a schedule is used.
- 02Verify a written contract requiring the waiver was executed before any loss.
- 03Check the policy period covers the work.
- 04Confirm separate WC and umbrella waivers if the contract requires them.
Which edition do you have?
12 19 added the blanket option that 05 09 lacked: subrogation is waived wherever a written contract executed before the loss requires it, in addition to any scheduled parties. Confirm the blanket wording is actually engaged on the issued form.
Common mistakes
- ·Assuming blanket coverage when only the scheduled portion of the form was completed.
- ·Forgetting the waiver must be required by a written contract in force before the loss.
Frequently asked questions
Does CG 24 04 12 19 provide a blanket waiver?
It can — the 12 19 edition added optional blanket wording that waives subrogation wherever a written contract executed before the loss requires it, without scheduling each party.
Is the 12 19 edition better than 05 09 for a GC?
Usually yes, because its blanket option removes the risk of your name being left off the schedule.
Does it cover workers' comp subrogation?
No. It's CGL only; require WC 00 03 13 for workers' comp.
